Letters to Contractors Regarding Bridging of the Existing Collective Agreement
RE: From January 1, 2020 until collective bargaining concludes a new maintenance collective agreement for Boilermakers, the January 1, 2017 – December 31, 2019 version of the National Maintenance Agreement applies to boilermakers
We want to ensure that all contractors who employ our members performing maintenance work apply the correct version of the National Maintenance Agreement to our members from January 1, 2020 and continuing during the time we are engaged in collective bargaining.
The January 1, 2017 – December 31, 2019 version of the National Maintenance Agreement (copy attached) will continue to apply to all Boilermaker Local 146 members who are working from January 1, 2020 until a new maintenance collective agreement is finalized between the Boilermakers and the contractors who are using the Boilermakers Contractors Association as their bargaining organization.
Neither the Extraordinary Measures Memorandum of Understanding (which specifically expires on December 31, 2019 as set out in its section 1) or the replacement to the NMA that has been negotiated by other trades besides boilermakers will apply to our members from January 1, 2020 onwards.
The existing NMA applies due to the application of section 130 of the Labour Relations Code which bridges the existing collective agreement during the time in which the parties are engaged in negotiating a new collective agreement.
Thank you for taking steps to apply the correct agreement to our members. The Boilermakers will be taking steps to enforce this requirement if necessary but we are hopeful that such is not required. If you have any questions feel free to contact us.
